Liability for Wrongful Arrest

Arrests are made at the risk of the arresting party. If, subsequently, the claim fails or the arresting party was not entitled to enforce his claim against the vessel, then the arrest will in principle be unlawful and the arresting party will be liable for the costs, expenses and damages resulting from such an arrest. The fact that the Court has granted leave for the arrest is of no affect.
